Oklahoma Personal Injury Attorneys

Help for people hurt in car and truck wrecks, and for families after a wrongful death. Free, confidential consultations in Tulsa, Oklahoma City and across Oklahoma.

You should not carry the cost of someone else's carelessness

When another driver or company causes a wreck, the law lets you seek payment for your medical bills, lost pay and the harm to your life. That claim is usually made against an insurance company, and the insurance company has its own people working to pay as little as possible.

We represent people injured in car wrecks and in truck and 18-wheeler wrecks, and families who lost someone they love. Laurie Koller has practiced law since 1991 and has tried over 100 cases. She is a past president of the Oklahoma Association for Justice and was named its Trial Lawyer of the Year in 2022.

If you are hurting, missing work and getting calls from an adjuster, you do not have to sort it out alone. Call (918) 221-3861 and we will walk through what happened with you.

Do not give a recorded statement to the other driver’s insurance company before you talk to a lawyer.

01

How long you have to file

In most cases, Oklahoma gives you two years from the date of the injury to file a personal injury lawsuit. That rule comes from Oklahoma’s statute of limitations, 12 O.S. § 95. Wrongful death claims usually have two years as well, counted from the date of death.

Two years can pass faster than you expect while you are healing, and some claims have shorter deadlines or special notice rules. Talk to a lawyer about your deadline early, so evidence can be gathered while it still exists.

02

What happens if you were partly at fault

You may still have a claim even if you were partly at fault. Oklahoma uses a comparative fault rule, found in 23 O.S. § 13. Under it, your recovery is reduced by your share of fault, and you cannot recover if your share is greater than the other side’s.

Insurance adjusters know this rule well. They often try to shift more of the blame onto you, because every bit of fault they assign lowers what they pay. Do not guess about fault or apologize in writing. Let the evidence, the police report and witness accounts show what happened.

03

How insurance adjusters handle injury claims

The other driver’s insurance adjuster works for the insurance company, not for you. Adjusters are often friendly, and many calls come within days of the wreck. Common moves include:

A fast offer can look tempting when bills are piling up. Once you accept a settlement, though, you usually cannot ask for more later, even if you need surgery or more treatment. It is worth talking to a lawyer before you sign anything.

04

Recorded statements and what to say

You do not have to give a recorded statement to the other driver’s insurance company, and it is usually wise to talk to a lawyer first. Your words can be replayed, picked apart and used to argue that you were at fault or not really hurt.

If an adjuster calls, you can politely say you are not ready to give a statement and write down their name and claim number. You should still report the wreck to your own insurance company as your policy requires. If you are unsure what to say, call (918) 221-3861 before you call them back.

05

Truck wrecks and families who lost someone

Truck wrecks often involve more than one responsible party. The driver, the trucking company, the company that loaded the cargo and the company that maintained the truck may each play a part. Commercial drivers also follow federal safety rules, such as limits on how many hours they can drive. Our page on 18-wheeler and commercial truck claims explains what we look at.

When a wreck takes a life, Oklahoma law generally allows one wrongful death lawsuit, usually brought by the personal representative of the estate on behalf of the family. Common questions

Questions people ask after a wreck

How long do I have to file a personal injury claim in Oklahoma?

In most cases, Oklahoma gives you two years from the date of the injury to file a lawsuit, and wrongful death claims usually have two years from the date of death. Some claims have shorter deadlines or notice rules, and waiting can make evidence harder to find. Talk to a lawyer about your deadline as soon as you can. A consultation is free and confidential.

Can I still recover if I was partly at fault?

Often, yes. Under Oklahoma's comparative fault rule, your recovery is reduced by your share of fault, and you cannot recover if your share is greater than the other side's. Fault is often disputed, and insurance companies may push more blame onto you than the facts support. We look at the evidence to show what really happened.

Should I talk to the other driver's insurance company?

You can give basic facts, like your name and contact information, but it is wise to talk to a lawyer before giving a recorded statement or signing any forms. The adjuster's job is to protect the insurance company, and what you say can be used to lower or deny your claim. If you have already talked to them, that is all right. Tell us what was said.

What if the insurance company already made me an offer?

Do not sign anything until you understand what you are giving up. Early offers often come before you know the full cost of your injuries, and accepting usually ends your claim for good. We can review the offer with you and explain what your claim may include. That review starts with a free, confidential consultation.

How much does it cost to talk to you?

Consultations are free and confidential. Talking with us costs nothing and does not commit you to anything. If you decide to work with us, we will explain how fees and case costs work, in plain language, before you sign anything. You are welcome to ask any question about cost.
