Oklahoma Car Wreck Lawyers
Help for people hurt in car wrecks in Tulsa, Oklahoma City and across Oklahoma. Free, confidential consultations.
After a wreck, you should not have to fight the insurance company alone
If you were hurt in a car wreck that someone else caused, you may be able to recover your medical bills, lost pay and more from the at-fault driver and their insurance. What you do in those first weeks can shape the whole claim.
Car wrecks are part of our personal injury practice. Our all-female team includes two attorneys. Laurie Koller has practiced law since 1991 and has tried over 100 cases. Laura Martinez speaks Spanish, so families can talk through a claim in the language they are most comfortable with.

What to do after a car wreck
The most important things to do after a wreck are to get medical care and to save the evidence. If you can, take these steps:
- Call 911 and ask for a police report, even if the crash seems minor.
- Get checked by a doctor the same day or as soon as you can. Some injuries show up later.
- Take photos of the cars, the road, your injuries and any skid marks or debris.
- Write down the names and phone numbers of witnesses.
- Keep every medical bill, receipt and note from work about missed time.
- Tell your own insurance company about the crash, but keep it to the basic facts.

Recorded statements and quick offers
You do not have to give a recorded statement to the other driver’s insurance company. Adjusters are trained to ask leading questions about fault, how fast you were going and whether you were already hurt before. Your answers can be used later to reduce or deny your claim.
Be careful, too, with forms that let the insurer pull all of your medical records, and with a quick settlement offer. An early offer often comes before you know how serious your injuries are or how long treatment will take. Once you accept, you usually cannot ask for more. Before you sign anything, call us at (918) 221-3861.

Fault, insurance and uninsured drivers
Most wrecks come down to a driver who was not paying attention or not following the rules. Common causes include distracted driving, speeding and aggressive driving, drunk driving, failing to yield, following too closely, unsafe lane changes and dangerous road conditions. Injuries range from whiplash and back injuries to broken bones and brain injuries.
Oklahoma uses a comparative fault rule. If you were partly at fault, your recovery is reduced by your share of fault, and you cannot recover if your share is greater than the other side’s.
Oklahoma requires drivers to carry at least 25/50/25 in liability insurance: $25,000 for injury to one person, $50,000 for all injuries in one crash and $25,000 for property damage. A serious injury can cost far more than that. Uninsured motorist coverage on your own policy can help when the other driver has no insurance, not enough insurance, or drives away. The Oklahoma Insurance Department explains how uninsured motorist coverage works.

How long you have to file
In most cases, Oklahoma gives you two years from the date of the injury to file a personal injury lawsuit. Some claims have shorter deadlines or extra steps, such as claims against a city or state agency. Please talk to a lawyer about your deadline rather than waiting until the end.
If you lost a family member in a crash, our page on wrongful death claims for families explains how those cases work. When you are ready, contact our Tulsa office or call (918) 221-3861.

Common questions
Questions about car wrecks
Do I need a lawyer for a car wreck claim?
Not every fender bender needs a lawyer. If you were hurt, missed work, or the insurance company is blaming you or offering very little, it is worth a free conversation. A lawyer can deal with the adjusters, gather evidence and help you understand what your claim is worth before you sign a release.
What if I was partly at fault?
You may still be able to recover. Under Oklahoma's comparative fault rule, your recovery is reduced by your share of fault, and you cannot recover if your share is greater than the other side's. Fault is often disputed, and the evidence can change the picture. Do not assume you are to blame just because an adjuster says so.
The other driver had no insurance. What now?
Look at your own policy for uninsured motorist coverage. In Oklahoma, insurers must offer it, and it can pay for injuries caused by a driver with no insurance, too little insurance, or a hit-and-run driver. We can help you make that claim against your own insurer. Bring your policy to the consultation if you can.
How long do I have to file a lawsuit?
In most cases, Oklahoma gives you two years from the date of the injury. Some claims, including claims against a city, county or state agency, have shorter deadlines or written notice rules. Talk to a lawyer about your deadline as early as you can, because evidence also fades with time.
